1. Introduction and Acceptance of Terms

By booking, purchasing, accessing, or using any of our services, you agree to be bound by these Terms and all applicable laws and regulations of Canada and the Province of British Columbia. If you do not agree to these Terms, you must not use our services.

If you are using our services on behalf of another person, a household, or a business, you represent and warrant that you have the authority to bind that person or entity to these Terms.

2. Scope of Services

Maple Paws Pet Care provides pet care services, which may include, without limitation:

  • Dog walking
  • Pet grooming
  • Pet daycare
  • Overnight pet boarding
  • Cat sitting
  • Basic pet wellness check-ins

The availability, duration, pricing, and specific features of services may vary based on scheduling, pet suitability, location, staffing, and other operational considerations. We reserve the right to refuse, suspend, or discontinue services at our discretion where necessary for safety, health, legal compliance, or operational reasons.

Our services are intended for domesticated companion animals only and are subject to the pet’s health, temperament, age, vaccination status, and behavioral suitability. We do not provide veterinary services, emergency medical treatment, or professional training unless expressly stated in writing.

3. User Obligations and Responsibilities

By using our services, you agree to the following obligations:

  • You must provide accurate, complete, and current information about yourself, your pet(s), and any relevant emergency contacts.
  • You must disclose all known medical conditions, allergies, behavioral issues, bite history, aggression, anxiety, escape tendencies, special needs, medications, and other relevant information about your pet.
  • You must ensure your pet is appropriately vaccinated, licensed where required, parasite-free, and in suitable health for the requested service.
  • You must provide all necessary supplies, instructions, and equipment unless otherwise agreed in writing.
  • You must ensure that your pet’s collar, harness, leash, crate, carrier, and identification tags are safe and functional where applicable.
  • You are responsible for obtaining and maintaining any required permissions, consents, or authorizations for the pet’s care.
  • You must promptly notify us of any changes in your pet’s health, behavior, or care instructions.
  • You must not request services for any pet that is ill, contagious, injured, or otherwise unsuitable for care without prior disclosure and written approval from us.
  • You must comply with all pickup, drop-off, scheduling, and access instructions provided by Maple Paws.

You acknowledge that failure to disclose material information may result in service refusal, immediate termination of services, additional charges, or liability for resulting losses, injuries, or damages.

4. Payment Terms and Conditions

Fees for services will be communicated at the time of booking, in a service agreement, invoice, or on our website, as applicable. All prices are stated in Canadian dollars unless otherwise indicated.

  • Payment may be required in advance, at the time of booking, upon completion of service, or according to the invoice terms provided by Maple Paws.
  • We may require deposits, pre-authorizations, or full prepayment for certain services, including overnight boarding, daycare, or peak-period bookings.
  • Late payments may be subject to administrative fees, interest, collection costs, or suspension of services, to the extent permitted by law.
  • You are responsible for all applicable taxes, including GST/HST/PST where applicable.
  • Any chargebacks, payment disputes, or failed payments may result in immediate suspension of services and recovery of associated costs.

If a pet requires additional care, extended supervision, emergency transport, cleaning, medication administration, or other unplanned services, you authorize us to charge reasonable additional fees, provided such charges are permitted by law and consistent with the circumstances.

5. Cancellation and Refund Policy

Cancellation and refund terms may vary depending on the service type, booking time, and notice provided. Unless otherwise stated in writing, the following general policy applies:

  • Cancellations made with reasonable advance notice may be eligible for a full or partial refund, less any non-refundable deposit or processing fee.
  • Late cancellations, no-shows, or same-day cancellations may be charged in full or partially, depending on the service reserved and the loss incurred by Maple Paws.
  • Overnight boarding, daycare, holiday bookings, and recurring services may be subject to stricter cancellation rules and non-refundable deposits.
  • Refunds will not be issued for services already rendered, except where required by law or expressly agreed by Maple Paws in writing.
  • If we must cancel or terminate a service for safety, health, legal, or operational reasons, we may provide a prorated refund for any unused portion of prepaid services, where appropriate.

We reserve the right to modify cancellation terms for special promotions, seasonal services, or custom agreements, provided such terms are disclosed at the time of booking.

6. Liability Limitations

To the fullest extent permitted by applicable law, Maple Paws Pet Care, its owners, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, emotional distress, or business interruption, arising out of or related to the use of our services.

You acknowledge and agree that pet care involves inherent risks, including but not limited to illness, injury, escape, theft, behavioral incidents, allergic reactions, property damage, and unforeseen emergencies. While we take reasonable precautions and exercise professional care, we do not guarantee that such risks will not occur.

To the maximum extent permitted by law:

  • We are not liable for pre-existing conditions, undisclosed medical issues, or behavioral problems of your pet.
  • We are not liable for injury, illness, death, or loss resulting from false, incomplete, or withheld information provided by you.
  • We are not liable for damage caused by your pet to property, people, animals, or third parties, except to the extent caused by our gross negligence or wilful misconduct where liability cannot be excluded under law.
  • We are not responsible for delays or failures caused by events beyond our reasonable control.

Where liability cannot be excluded under applicable law, our total aggregate liability for any claim arising from or relating to the services shall be limited to the amount paid by you for the specific service giving rise to the claim, except where prohibited by law.

Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded under applicable Canadian law, including liability for fraud, wilful misconduct, or other non-excludable obligations.

7. Intellectual Property Rights

All content, materials, branding, logos, text, graphics, images, service descriptions, website design, and other intellectual property associated with Maple Paws Pet Care are owned by or licensed to Maple Paws and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, display, publish, transmit, create derivative works from, or otherwise exploit our intellectual property without our prior written consent, except as permitted by law.

Any feedback, suggestions, or ideas you submit to us may be used by Maple Paws without restriction or compensation, unless otherwise agreed in writing.

8. Data Protection and Privacy

We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, British Columbia privacy legislation.

Personal information may include your name, contact details, address, payment information, pet information, emergency contacts, service history, and other information necessary to provide our services and manage our business operations.

We may use personal information to:

  • Provide and manage services
  • Communicate with you about bookings, billing, and service updates
  • Maintain safety, health, and emergency records
  • Comply with legal and regulatory requirements
  • Improve our services and customer experience

9. Force Majeure

Maple Paws Pet Care shall not be liable for any delay, interruption, failure, or inability to perform any obligation under these Terms due to events beyond our reasonable control, including but not limited to:

  • Severe weather
  • Natural disasters
  • Fire, flood, earthquake, or power outage
  • Pandemic, epidemic, or public health emergency
  • Government action, order, or restriction
  • Labour disputes
  • Transportation disruptions
  • Equipment failure or utility interruption
  • Any other event beyond our reasonable control

In such circumstances, we may reschedule, modify, or cancel services without liability, except for any refund or credit required by law or expressly agreed in writing.

10. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The updated Terms will be effective upon posting or upon the date specified in the revised version, whichever is later.

Your continued use of our services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of our services.

11. Applicable Law and Jurisdiction

These Terms and any dispute, claim, or matter arising out of or relating to them, the services, or your use of our services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that the courts located in Vancouver, British Columbia shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or our services, except where applicable law requires otherwise.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed or limited to the minimum extent necessary so that the remaining provisions remain in full force and effect.

The failure of Maple Paws Pet Care to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision unless acknowledged in writing by us.
